Most rent agreements in Nepal are handwritten, or photocopied from whatever a neighbour used. They usually leave out exactly the terms that later cause the argument — how much notice to give, what the deposit covers, who pays when the tap breaks.

What a rent agreement should contain

Both parties in full, with citizenship numbers and phone numbers, so the agreement identifies who is bound by it. A first name and a phone number is not enough if it ever has to be shown to anyone.

The property described specifically. "Second floor, two rooms, one kitchen, one bathroom" prevents the argument about whether the terrace or the parking space was included.

Rent in figures and in words, the date it is due, and the deposit. Writing the amount twice is not bureaucratic habit — it is what stops a figure being altered later.

The term, and the notice period. Thirty-five days is the common convention in Nepal, but it only binds anyone if it is written down.

Who pays for electricity, water, waste collection and internet. This is the single most common cause of a monthly disagreement, and it takes one line to settle.

Terms worth deciding before you sign

Rent increases. A clause capping the rise, and requiring notice, protects the tenant and gives the landlord a clear basis to raise it. Without one, every renewal is a negotiation from nothing.

Repairs. The usual split is that the tenant handles day-to-day maintenance and the landlord handles structural, plumbing and wiring work. Say so, or it becomes an argument at the worst moment.

The deposit. State when it is returned and what may be deducted. "Damage beyond normal wear and tear" is the phrase that matters — without it, any mark on a wall becomes a deduction.

Subletting. Landlords almost always intend to prohibit it and almost never write it down.

Witnesses and signing

Nepali practice is two witnesses, each signing with their name and address. The template leaves space for both, along with the two parties.

Print two copies and have both signed, so each party holds an original. A photograph of a signed agreement on someone's phone is far weaker than a signed paper copy if it is ever disputed.

Common questions

Does a rent agreement need to be registered or notarised in Nepal?

A written agreement signed by both parties and two witnesses is what most tenancies use in practice. Registration is generally associated with longer or commercial leases, and requirements vary by municipality — check with your ward office if the tenancy is long-term or high-value.

Can I write the agreement in Nepali?

Yes. Type Nepali into any field and it renders correctly in the PDF. You can mix Nepali and English in the same document if that is how the parties want it.

Is this legally binding?

This produces a template, not legal advice. A written, signed and witnessed agreement carries real weight, but every tenancy differs — read every clause, change what does not match what you agreed, and consult a lawyer for anything high-value or already contentious.
