Quick answer
An agreement paper (सम्झौता पत्र) records what two or more people have agreed. Under Nepal's Civil Code an agreement binds when both consent, both can contract, and its subject is definite and lawful. Most may be written or spoken, but a lease of land and house rent above Rs 20,000 a month must be written, and a land sale must be registered.
People search for "agreement paper" when they need one for something specific — a room, a plot, a loan, a bike, a house being built — and find a rent agreement whatever they asked for. This page lists the agreements people in Nepal most often need, with a maker for each, and sets out what the National Civil (Code) Act 2074 says about all of them: when an agreement binds, which must be in writing, and which must be registered.

What makes an agreement valid
The Civil Code treats an agreement as a contract once one person accepts what another has offered (section 504). It binds — is enforceable by law — when four things are true (section 505):
- Both consent to be bound by it.
- Both can contract. A minor or a person of unsound mind cannot; a guardian contracts for them, and a company contracts through its authorised directors (section 506).
- Its subject is definite — what is being sold, lent, let or done, and for how much.
- It is lawful. An agreement to do something the law forbids binds no one.
Which must be written, and which registered
A बैना is the agreement to sell, not the sale. The land changes hands only when the राजिनामा is registered at the land revenue office.
| Agreement | In writing | Registered | Civil Code |
|---|---|---|---|
| House rent | Yes, once the rent passes Rs 20,000 a month — with the tenant's photograph and at least two witnesses for each side | If the rent is above Rs 1,00,000 a month | Sections 386, 464 |
| Lease of land or other immovable property | Always | If it runs for more than ten years | Section 620 |
| Transfer of land or a house (राजिनामा), gift, exchange, partition, mortgage | Yes | Always, at the land revenue office — or it is not legally recognised | Section 464 |
| A loan (तमसुक) or any give-and-take of money | A deed for every transaction; a receipt counts as one | No | Sections 476, 484 |
| Vehicle sale, partnership, construction, consent | Not required by the Code — but write it | No | Section 505 |
The parts every agreement paper has
Every maker on this site asks for these in this order, and prints them the way a Nepali office expects to read them, in Nepali or English.
- The date and the place it was signed.
- The parties, each with full name, address and citizenship number. A deed of a transaction also names the father, mother and grandparents, and the husband or wife of a married person (section 477).
- What is agreed — the room, the plot by its kitta number, the vehicle by its engine and chassis numbers, the amount in figures and words.
- The terms: period, payment, what each side must do, what happens if one side backs out, how a dispute is settled.
- Signatures and thumbprints (सहीछाप) of both parties, and of the witnesses.
Interest on a loan: the ten percent limit
A loan between people — a तमसुक — may carry interest only if the deed says so (section 479), and the Civil Code caps it: at most ten percent of the principal a year (section 478). Compound interest may not be charged (section 480), and the interest collected may never exceed the principal (section 481).
When the loan is repaid, the lender returns the deed marked as paid, or gives a receipt if the deed cannot be found (section 482). The receipt maker writes that one too.
Signing, witnesses and copies
Sign every page, and give each party a copy with original signatures. A house rent agreement needs at least two witnesses for each side (section 386); for the others, two witnesses who are not family and can be found later are the best evidence you can add for nothing.
Some offices — an embassy, a bank — ask for a notarised copy. Ask the office that will read the agreement what it wants before you sign it.
सम्झौता पत्रको नमुना — a simple agreement
For an agreement that has no maker of its own, this is the shape. Replace what is in [brackets].
Common questions
What is an agreement paper called in Nepali?
सम्झौता पत्र, or करार पत्र for a contract such as employment. A deed written between two people is a लिखत.
Is a verbal agreement valid in Nepal?
Yes, for most agreements: the Civil Code lets a contract be made in writing, verbally or by conduct (section 505). But house rent above Rs 20,000 a month and any lease of land must be written, and a land transfer must be registered, or they are not enforceable.
Who can sign an agreement?
Anyone who is not a minor and is of sound mind (section 506). A guardian signs for a minor, and a company signs through a director or a person the directors have authorised.
Do I need a lawyer to write an agreement?
Not for most everyday agreements; the makers here cover the usual terms. For anything of high value, already disputed, or being registered, have a lawyer read it before you sign.
